Relevant Sections From the TOS
Section O.2. of the TOS states:
Should any Content be reported to Yaoi Journal as being offensive or inappropriate, Yaoi Journal might call upon the author to retract, modify, or protect (by means of private viewing settings) the Content in question within a reasonable amount of time, as set forth by the Yaoi Journal staff. Should the author fail to meet such a request from Yaoi Journal staff, Yaoi Journal has the full authority to terminate any such reported and verified offensive account holding such inappropriate content. Yaoi Journal, however, is under no obligation to restrict or monitor journal Content in any way;
Section P of the TOS states:
You agree to NOT use the Service to:
1. Upload, post or otherwise transmit any content that is in Yaoi Journal’s opinion to be unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive to another’s privacy (up to, but not excluding any address, email, phone number, or any other contact information with out the written consent of the owner of such information), hateful, or racially, ethnically or otherwise objectionable;
3. Impersonate any person or entity, including, but not limited to, a Yaoi Journal staff member or volunteer, or falsely state or otherwise misrepresent your affiliation with a person or entity;
7. Upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
8. Upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
9. Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
11. “Stalk” or otherwise harass another person or company;
12. Collect or store personal data about other users for business purposes;
13. Promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, but is not limited to, providing instructions on how to assemble bombs, grenades and other weapons or incendiary devices;
If any user is reported to be in violation with the letter or spirit of these terms, Yaoi Journal retains the right to terminate such account at any time without further warning. Yaoi Journal reserves the right to be the sole decisive as to if any of the above applies to each individual case. Yaoi Journal reserves the right to change or alter the above depending on the situation and condition. You also accept that abuse decisions are final, and are not up to debate or discussion.
What is Abuse?
Abuse on Yaoi Journal is taken very seriously and can be summarized as follows:
- Abuse of service via spam.
- Abuse of service via providing or uploading malware.
- Abuse of service by impersonating Yaoi Journal staff or volunteers.
- Abuse of service via DOS and computer attacks directed at Yaoi Journal and its server.
- Abuse of service through the collection of information for business purposes.
- Abuse of a person by publishing their personal information.
- Abuse of a person or organization through harassment.
- Abuse of a person or organization through hateful speech.
- Abuse of a person or organization via stalking.
- Serious discussion regarding acts of cruelty and harm towards animals and persons.
How to Report Abuse
It is important to gather as much information as possible. Send an e-mail with the following information where possible:
- Offender information.
- Screen captures and URLs.
- Date, time and description of abusive activity.
Investigation
Once your report is received, an investigation will be conducted. Investigation will proceed as quickly as possible, and may require the gathering of additional information. Your identity will be kept private.
You will be notified on the results of the investigation. Your report will not be made public, and you will not be identified. Should you choose to disclose your report to any other person, or the results of the investigation, you do so at your own risk.
Enforcement
Yaoi Journal will immediately enforce its decision based on the results of the investigation. Depending on the severity of the infraction, any of the following actions may result:
- Request for a post or page’s removal (or removal of post or page by Yaoi Journal’s abuse team).
- Suspension of a user’s account for a period of time.
- Termination of a user’s account.
- Blocking of an individual and/or IP address.
Decisions are final and binding, unless there are extenuating circumstances, and this is at the sole discretion of the Yaoi Journal abuse team.
Under Age Reports
Yaoi Journal also takes reports of those under the age of 18 very seriously. If you are reporting someone as being under 18, you must provide as much proof as possible (see above). If the results of the investigation indicate that there is at least a good likelihood that someone is under 18, the following action will be taken:
- They will receive an under age notice, with a request for proof of age, and
- Their account will be suspended until they provide such proof.
